Lynn Vuketich Luther Quoted in Daily Labor Report on ADA Suit Involving Coverage for Former Employees

Lynn Vuketich Luther, a member in Eastman & Smith’s Labor & Employment Group, spoke with Bloomberg Law’s Daily Labor Report about a case slated for review by the U.S. Supreme Court involving “employers’ benefits obligations to former employees.”

The article “Ex-Worker’s High Court ADA Suit Raises Future Benefits Questions,” discusses Stanley v. City of Sanford,  a matter now under review by the justices to determine whether former employees are able to file a suit under the ADA regarding discriminatory post-employment policies.

According to Daily Labor Report, “[the] case could resolve a split among six federal appellate courts,” and Ms. Luther believes the decision has the potential to “dissuade employers from offering post-employment benefits to workers with disabilities” to avoid bias litigation and difficulties implementing program adjustments. She noted “The ability to modify those programs to control costs is essential in this labor market in particular because a lot of those companies now want to shift those resources toward securing new talent and investing in their current employees.”

As the legal community anticipates the Supreme Court’s verdict, the implications for employers’ post-employment benefit offerings hang in the balance.
