Gregg and Hartman Secure Workers Comp Victory

Eastman & Smith members Joseph A. Gregg and Heidi N. Hartman secured a defense victory in a workers' compensation case. The plaintiff in the case sustained injuries while at work. Plaintiff argued that since his injuries occurred at work that alone should entitle him to workers' compensation. Mr. Gregg and Ms. Hartman argued that (a) since the injury did not arise out of anything having to do with work, i.e., the plaintiff was injured while running through the plant of his own volition and (b) the injuries were caused by a condition personal to the plaintiff, the plaintiff was not entitled workers' compensation just because the injury occurred while the plaintiff was at work. After less than a half hour of deliberation, the jury returned a verdict for the defense.
