Nooney and Diedrich Win Workers' Comp Case

Member James F. Nooney and associate Colleen L. Diedrich successfully defended a workers' compensation claim in common pleas court. At issue was whether or not a C4-5 disc bulge that resulted in a C4-5 fusion in 2009 had occurred at the time of a work related disc C3-4 herniation six years earlier and was thus compensable. The employer appealed the plaintiff's receipt of workers' compensation benefits for the injury, contending that the C4-5 disc bulge was unrelated to the event that had caused the C3-4 herniation. The jury agreed, finding for the defense.
