Harper and Sandretto Win Defense Verdict in Federal Court

Attorneys Matthew D. Harper and Mark W. Sandretto obtained a defense verdict in a contract dispute tried to a 12 person jury in federal court. In the case, the plaintiff agreed to purchase an industrial machine from the defendant. After accepting delivery of the machine, the plaintiff refused to pay for it, claiming the defendant breached the contract by delivering the machine late. (Plaintiff also raised other claims which were dismissed before trial on summary judgment.) In its defense, the defendant showed that the plaintiff's own actions forced any delay in delivery and that, in any event, the plaintiff never gave adequate notice of the late delivery claim after accepting the machine. At the close of the trial, the jury agreed with the defense and entered a verdict accordingly.
