Sixth Circuit Rules in Favor of Eastman & Smith Client and Deepens Circuit Split

7/15/22

The Sixth Circuit Court of Appeals recently affirmed a decision from the Southern District of Ohio dismissing a civil RICO case filed against an Eastman & Smith client for lack of personal jurisdiction. The decision deepens a split between the appellate circuits regarding the proper interpretation of the federal RICO statute and whether it provides for nationwide jurisdiction. The case was successfully briefed and argued on appeal by Eastman & Smith member Jared J. Lefevre, who handles complex civil litigation and appeals at Eastman & Smith. Shanna M. Kaminski of Kaminski Law, PLLC served as co-counsel in the underlying case.
