Harper and Cavanaugh Obtain Dismissal At Close of Plaintiff's Case

Attorneys Matthew D. Harper and Tiffany E. Cavanaugh defended a molding company at trial which had been sued for conversion of personal property. Specifically, the plaintiff alleged that the defendant had wrongly disposed of certain property for which he sought damages in excess of $1,000,000. After plaintiff rested his case, Mr. Harper and Ms. Cavanaugh moved for dismissal, which the court granted because the same claims had already been dismissed in an earlier lawsuit, the time limit for bringing the suit had expired, and no written contract existed. Mr. Harper is admitted in state and federal courts throughout Ohio and Michigan where he represents parties in business and construction disputes of all kinds. He also has represented clients in cases involving unfair competition, trade secrets and trust and will disputes. Ms. Cavanaugh concentrates her practice in the area of commercial litigation and represents clients in a wide range of matters, including contract disputes, contract negotiation, collection, bankruptcy, copyright infringement and business tort actions. Both attorneys are based in our Toledo office.
