Eastman & Smith Secures Victory Before Ohio Supreme Court
Eastman & Smith Ltd. secured a victory for Defendant Sky Bank - Ohio Bank Region (now part of The Huntington National Bank) in the Ohio Supreme Court in Spiller v. Sky Bank - Ohio Bank Region. The appeal dealt with Ohio Revised Code Sec. 1109.69, which sets the time periods for which banks must retain records and during which lawsuits against banks depending on such records must be brought. Firm member Matthew D. Harper led the firm's team and presented oral argument before the Court on March 25, 2009. The Ohio Supreme Court dismissed all of the plaintiff's claims against the Bank as untimely under the statute. The decision reversed both the Court of Appeals and the Trial Court, both of which had rejected the Bank's argument.
