Stopar, Lefevre and Carey Successful in Ohio Supreme Court Case
Eastman and Smith Ltd. attorneys Jeffrey M. Stopar, Jared J. Lefevre and John M. Carey successfully argued in the Ohio Supreme Court that Ohio law does not recognize a cause of action for tortious acts in concert under Section 876, Restatement (2d) of Torts. The case involved a dispute over milk premiums, in which a milk producer sued a milk cooperative over price premiums, and alleged that the milk cooperative and its marketing contractors committed tortious acts in concert. In a 6 to 1 decision, the Supreme Court agreed that Ohio law has not recognized that claim and declined to do so under the facts of this case.
