Scott A. Johnson Publishes Article in MG Magazine on Legalization of Recreational Marijuana in Ohio

Eastman & Smith member Scott A. Johnson published an article entitled “Uncertainty Prevails Entering a New Era of Legalized Adult Use Cannabis in Ohio,”  in the March 2024 issue of MG Magazine. The article discusses Ohio’s vote to legalize recreational marijuana.

Issue 2 was passed on November 7, 2023, and became effective one month later. Since Issue 2 was a legislative initiative rather than a constitutional amendment, the new statute can be changed or even repealed by the Ohio General Assembly.

As it stands, several bills were introduced to make changes to the law, but none have been enacted.  Possible changes include how many plants people may grow at home, allowing local jurisdictions to bar marijuana businesses and expungement of some convictions involving marijuana.

In his article, Mr. Johnson writes: “Although there does not appear to be a groundswell of support within the legislature to repeal adult-use legalization, actions and comments by the governor and members of the legislature suggest amendments are imminent.”
