Casey and Pawlicki Prevail at Trial
6/9/09
Recently Peter R. Casey III and Sarah E. Pawlicki, attorneys in Eastman & Smith's Litigation and Labor and Employment Sections, prevailed after a bench trial in the Lucas County Common Pleas Court on behalf of a self-insured employer in a workers' compensation case. The case involved an allegation by a claimant that he injured his back while stepping down and twisting at work. The court found that the claimant did not establish that his conditions, including degenerative low back conditions, were caused by his work activities. As a result of the favorable verdict, the self-insured employer avoided what could have amounted to at least two years worth of disability compensation and payment of medical expenses.
